Terms and Conditions

  1. The Black Bird – reenactment clothing store with the website address
    www.blackbird-rc.com is an online store run by Black Bird – reenactment clothing
    Michał Cieślik, ul. Pawliczka 14/20 41-800 Zabrze NIP: 6482755064 REGON
    388570998, hereinafter referred to as the seller.
  2. All products are new, free from any defects, manufactured to the customer’s order
    or in single copies.
  3. To place an order, please send an inquiry via the contact form available after
    clicking the „contact” option. We sew to order, so please include the selected clothing
    pattern, photo or drawing, and dimensions in your message. Measurement
    instructions can be found in the „dimensions” tab. The rest of the details are agreed
    individually with each client.
  4. Orders are processed within 3 months of receiving payment from the buyer.
    Payment in full or advance payment of at least half price. Shipping time depends on
    the customer’s address and delivery method. We send orders via courier or Inpost
    parcel lockers. In the case of shipments abroad, we ship by courier according to the
    price list to a given country.
  5. The customer can pay for the ordered goods by transfer to the seller’s account or
    via the PayPal payment service.
  6. The buyer may also collect the products he has ordered personally at ul. Pawliczka
    14/20 in Zabrze by appointment.
  7. For each order, we issue a VAT invoice or a bill for the purchased products. When
    placing an order, please provide your invoice details.
  8. The seller ensures that personal data provided during the order are collected and
    processed in accordance with and based on the Act of August 29, 1997 about
    personal data protection. The collected personal data is used only for the purpose of
    fulfilling placed orders and informing about promotions and under no circumstances
    is and will not be made available to third parties.
  9. Customer in accordance with Art. 32 of the Act on Consumer Rights, may
    withdraw from it without giving a reason by submitting an appropriate declaration
    within 14 days of receiving the product. In such a case, the customer is obliged to
    return the order intact and complete within 14 days. We will refund your payment
    within 14 days, excluding shipping costs.
  10. The right to withdraw from the contract is excluded if the order is tailor-made or
    non-standard, in accordance with Art. 38 of the Consumer Rights Act.
  11. Complaint. The basis and scope of the seller’s liability towards the customer if the
    sold product has a physical or legal defect (warranty) are specified in generally
    applicable legal provisions, in particular in the Civil Code. The seller is obliged to
    provide the customer with a product without defects. The complaint may be submittedby the customer in electronic form via e-mail to the following address:

    provide in the description of the complaint: (1) information and circumstances
    regarding the subject of the complaint, in particular the type and date of occurrence
    defects; (2) request how to bring the product into compliance with the sales
    agreement or a declaration of price reduction or withdrawal from the sales
    agreement; and (3) contact details of the person filing the complaint – this will
    facilitate and speed up the consideration of the complaint by the seller. The
    requirements set out in the previous sentence are only recommendations and do not
    affect the effectiveness of complaints submitted without the recommended
    description of the complaint. The seller will respond to the customer’s complaint
    immediately, no later than within 14 calendar days from the date of its submission.
    Failure to respond by the seller within the above deadline means that the seller
    considered the complaint justified. If it is necessary to deliver the product to the seller
    in order for the seller to respond to the customer’s complaint or to exercise the
    customer’s rights under the warranty, the customer will be asked by the seller to
    deliver the product at his expense. A request to deliver the product does not affect
    the deadline for the seller to respond to the customer’s complaint and does not
    violate the customer’s right to request the seller to dismantle the defective product
    and reinstall the product. after replacement with a defect-free one or removal of the
    defect or cash refund referred to in Art. 561[1] of the Civil Code.
  12. Copyrights, including all materials and their arrangement in the Online Store, are
    legally protected and constitute the intellectual property of the seller. Copying for
    commercial purposes, distribution, modification and publication without the written
    consent of the seller are prohibited. Some elements of the Online Store are the
    property of third parties and protected by copyright belonging to these entities.
  13. By placing an order, the customer consciously consents to the processing and
    use of his personal data for the purpose of fulfilling the order.
  14. The store reserves the right to change the regulations. Orders placed before the
    changes come into force are processed under the existing rules.
